From a legal point of view, Touch ID is more of a problem for the iPhone owner than an attacker. The Fifth Amendment to the US Constitution gives a person the right not to incriminate himself in court. The judge cannot demand from the defendant to testify about his intentions and thoughts. For example, if you are asked to enter a 4-digit PIN code to unlock your iPhone, then this is optional: the code is stored in your memory and you have the right not to provide it. Another thing is a fingerprint that is on a physical medium - your hand. The law does not prohibit fingerprinting and the removal of physical indicators from the defendant.
